These Terms & Conditions (“Terms”) govern all use of services provided by MonkeyMediaWebs (“we”, “our”, “us”).
By purchasing any service, subscription, or website package, the customer (“you”, “your”) agrees fully and unconditionally to these Terms.

1. Services Provided

MonkeyMediaWebs provides:

  • Website development

  • Hosting

  • Maintenance

  • Technical support

  • Content updates (minor)

  • Subscription-based services

All services are provided as-is, based on the approved project scope.

2. Contract Duration

All website packages—whether paid by one-time payment or monthly subscription—include a mandatory 24-month (2-year) contract.

By purchasing a service, you agree to complete and pay the full contract duration.

3. Payment Terms

3.1 One-Time Payment

Paid upfront and covers 24 months of service.

3.2 Monthly Subscription

Charged automatically each month for 24 months.

3.3 Failed or Late Payments

If a payment fails or remains unpaid:

  • Services may be paused

  • The customer remains responsible for the remaining contract payments

  • Administrative fees may apply

  • Website ownership remains with MonkeyMediaWebs until all payments are completed

We are not responsible for downtime, data loss, or business interruption caused by unpaid invoices or suspended services.

4. No Refund Policy

All payments are non-refundable, including partial or full payments.
Early cancellation does not remove payment obligations.

5. Website Ownership

Before full contract payment:

MonkeyMediaWebs retains full ownership of all:

  • Website files

  • Code

  • Design

  • Hosting

  • Domains (if registered by us)

After full payment:

Ownership is transferred to the customer only after completing 24 months of payments.

We are not responsible for issues after transfer unless an active maintenance plan is in place.

6. Customer Responsibilities

You agree to:

  • Provide accurate and legal content

  • Ensure copyrights and usage rights for all materials

  • Review and approve all content

  • Follow all applicable laws

  • Maintain independent backups if desired

MonkeyMediaWebs is not responsible for customer-provided content or misuse.

7. Limitation of Liability

To the maximum extent permitted by law:

MonkeyMediaWebs is not liable for:

  • Loss of revenue or business

  • Downtime from third-party providers

  • Any data loss

  • Customer mistakes or unauthorized changes

  • Hacks caused by weak passwords or user-side errors

  • Service interruptions

  • Force majeure events

By using our services, you agree we cannot be held responsible for any damages of any kind.

8. Maintenance & Updates

Included:

  • Minor text changes

  • Security updates

  • Backups

Not included (extra costs apply):

  • Redesigns

  • New features

  • Advanced technical development

Delays caused by the customer are not our responsibility.

9. Service Suspension & Termination

We may suspend or terminate services immediately if:

  • You fail to pay

  • You violate these Terms

  • You use the website illegally

  • You misuse hosting or services

Suspension does not cancel payment obligations.

10. Third-Party Services

We may use third-party providers for hosting, analytics, and payments.

MonkeyMediaWebs is not responsible for:

  • Downtime caused by third parties

  • Third-party security issues

  • Third-party service changes

Use of third-party tools is at your own risk.

11. Indemnification

You agree to indemnify and hold harmless MonkeyMediaWebs from all claims, damages, or legal expenses arising from:

  • Your website content

  • Your business operations

  • Your breach of these Terms

  • Copyright violations

  • Illegal or harmful activities

This ensures we cannot be held responsible for customer actions.

12. Governing Law

These Terms are governed by Spanish law, and disputes are handled exclusively by the courts of Alicante, Spain.

13. Changes to Terms

We may update these Terms at any time.
Continued use of services means acceptance of any changes.
